These Terms of Service, together with our Privacy Policy, Shipping Policy and Returns and Refunds Policy, govern your use of our website and your purchase of products from us.

By accessing our website, using our services or placing an order, you agree to these Terms of Service.

Do not use our website or place an order if you do not agree to these Terms.

Adding an item to your cart does not reserve that item.

We may cancel or modify an order if a product becomes unavailable, has been incorrectly priced or cannot reasonably be supplied.

Where we cancel an order after payment has been received, we will refund the affected amount to the original payment method.

5. Orders

Submitting an order is an offer to purchase products from Halloween Haven.

An order is not accepted until we send you an order confirmation or otherwise confirm that the order has been accepted.

We reserve the right to accept, reject or cancel an order where reasonably necessary, including where:

• A product is unavailable

• Product or pricing information contains an error

• Payment cannot be processed

• We reasonably suspect fraud or unauthorised activity

• Incorrect customer or delivery information has been supplied

• An order breaches these Terms

• A product cannot legally or safely be delivered to the destination

Please carefully check your products, quantities, delivery address and contact information before submitting an order.

6. Order Changes and Cancellations

Contact us as soon as possible if you need to request an order change or cancellation.

We cannot guarantee that an order can be changed or cancelled after it has been submitted.

Once an order has been processed, ordered from a supplier, packed or dispatched, we may be unable to cancel or modify it.

Any cancellation rights available under the Australian Consumer Law or another applicable law are not affected by this section.

7. Prices and Payment

Unless otherwise stated, all prices displayed on our website are in Australian dollars.

Applicable delivery charges and other costs will be displayed before you complete checkout.

International customers may be responsible for customs duties, import taxes, processing charges or other fees imposed by their destination country. These charges are not controlled by Halloween Haven unless expressly included at checkout.

Prices, discounts and promotional offers may change without notice. Changes will not normally affect orders that we have already accepted, except where there has been an obvious pricing error.

You agree to provide accurate and authorised payment information.

By submitting an order, you confirm that you are authorised to use the selected payment method.

Payments may be processed by Shopify Payments or another third-party payment provider. We do not directly control the processing systems operated by these providers.

8. Pricing Errors

We reserve the right to correct genuine pricing, product description or promotional errors.

If an error affects an order you have placed, we may contact you and offer the option to:

• Cancel the affected item or order and receive a refund

We will not knowingly rely on a pricing error to mislead customers.

9. Discount Codes and Promotions

Discount codes and promotional offers:

• Must be used before their stated expiry date

• May be limited to selected products or customers

• Cannot be exchanged for cash

• May not be combined unless expressly permitted

• May be cancelled where obtained or used fraudulently

• May be subject to separate promotional conditions

Only one discount code may be used per order unless otherwise stated.

We may correct or withdraw a promotion where it contains a genuine error, subject to applicable law.

10. Shipping and Delivery

Delivery timeframes displayed on our website are estimates and are not guaranteed.

Delivery may be affected by carrier delays, severe weather, public holidays, customs processing, incorrect address information, supplier delays and other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address.

Contact us promptly if you notice an error in your delivery details. We cannot guarantee that an address can be changed after an order has been processed or dispatched.

We are not responsible for delays caused by incorrect or incomplete information supplied by the customer. Additional delivery costs resulting from an incorrect address may be charged to the customer where permitted by law.

If your tracking information shows that a parcel has been delivered but you cannot locate it, please:

1. Check around the delivery location.

2. Ask other occupants or neighbours.

3. Check for a safe-drop location or collection notice.

4. Contact the delivery carrier.

5. Contact us if the parcel remains missing.

Nothing in this section excludes any responsibility Halloween Haven has under the Australian Consumer Law for products that are not delivered, are damaged in transit or otherwise fail to meet a consumer guarantee.

11. Returns, Refunds and Exchanges

Returns, refunds and exchanges are governed by our Returns and Refunds Policy and the Australian Consumer Law.

Halloween Haven does not offer returns, refunds or exchanges solely because a customer:

• Changes their mind

• Orders the wrong item, size, colour or quantity

• No longer wants or needs the item

• Finds the item cheaper elsewhere

• Fails to review the product description or measurements

This change-of-mind policy does not limit your rights under the Australian Consumer Law.

You may be entitled to a repair, replacement, refund or other remedy if a product:

• Is faulty or damaged

• Is significantly different from its description

Proof of purchase may be required when making a claim.

Items should not be returned without contacting us first.

12. Sale and Clearance Products

Sale and clearance products are not eligible for change-of-mind returns.

However, sale and clearance products remain covered by applicable consumer guarantees.

A discounted price does not remove a customer’s rights where a product is faulty, damaged, unsafe or otherwise fails to meet a consumer guarantee, unless the specific defect was clearly disclosed before purchase.

13. Gift Cards

Gift cards:

• Cannot be exchanged for cash

• Must be used before any applicable expiry date

• Must be kept secure by the recipient

• May not be replaced if lost, stolen or used without authorisation, except where required by law

Gift cards remain subject to any rights that cannot legally be excluded.
